OVERVIEW

Welcome to We Grow Here Apparel.

The terms “WGH,” “we,” “us,” and “our” refer to We Grow Here Apparel.

We Grow Here Apparel operates this website and online store, including all related information, content, features, tools, products, and services made available to customers (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information regarding purchases, intellectual property, shipping, refunds, limitations of liability, and other legal rights and responsibilities.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to be bound by these Terms of Service and the policies incorporated into them, including our Privacy Policy, Shipping & Delivery Policy, and Refund, Replacement & Final Sale Policy.

If you do not agree with these Terms or applicable WGH policies, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian where required.

To access certain Services or make a purchase, you may be asked to provide information including your name, email address, billing information, payment information, and shipping information.

You represent that all information you provide is accurate, current, and complete and that you have the legal right to provide it.

You are responsible for maintaining the confidentiality and security of any account credentials associated with the Services.

You are responsible for activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person without our written permission.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately describe and display WGH products.

However, colors, textures, sizing, placement, printing, stitching, cutting, dimensions, and other product details may appear differently depending on screen settings, lighting, photography, manufacturing processes, materials, or normal production variation.

Minor variations that do not materially affect the appearance, function, wearability, or overall quality of a product are not considered defects.

Product photography, mockups, illustrations, and digital representations are intended to provide a reasonable representation of the product but may not reflect every minor physical variation.

Customers are responsible for reviewing product descriptions, sizing information, care instructions, pricing, and other available information before completing a purchase.

Product descriptions, availability, pricing, colors, sizes, designs, and quantities may change without notice.

We reserve the right to discontinue, limit, modify, or restrict the sale of any product at any time where permitted by law.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase products from We Grow Here Apparel.

WGH reserves the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases involving:

• Suspected fraud
• Payment problems
• Inventory errors
• Pricing errors
• Website errors
• Unsupported shipping addresses
• Product unavailability
• Repeated policy abuse
• Unusual order activity
• Other legitimate business or legal reasons

An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.

Customers are responsible for reviewing all order details before completing checkout, including:

• Product
• Size
• Color
• Quantity
• Shipping address
• Billing information
• Contact information
• Shipping method

Cancellation or order-change requests must be sent to info@wghapparel.com within two hours of purchase.

Submitting a request within two hours does not guarantee that the request can be completed.

Once an order enters fulfillment, WGH may be unable to cancel, change, redirect, intercept, or modify it.

Purchases are subject to the WGH Refund, Replacement & Final Sale Policy.

All WGH purchases are final sale except where WGH approves an eligible claim under that policy or applicable law requires otherwise.

Customers may not purchase WGH products for unauthorized commercial resale, reproduction, counterfeiting, or other unlawful commercial use.

SECTION 4 — PRICES, PAYMENT, AND BILLING

Prices, promotions, discounts, and product availability may change without notice.

The price charged for a product will generally be the price displayed at the time the order is submitted and confirmed.

Unless otherwise stated, product prices do not include applicable taxes or shipping charges.

Shipping charges are calculated separately during checkout.

You agree to provide accurate and complete purchase, billing, payment, and account information.

You represent that:

• Payment information provided is accurate
• You are authorized to use the selected payment method
• Charges associated with your purchase are authorized
• You will pay all applicable product, shipping, and tax charges

We may cancel or hold an order if payment cannot be verified or if additional verification is reasonably necessary.

SECTION 5 — FULFILLMENT, SHIPPING, AND DELIVERY

All WGH customer orders are fulfilled directly by We Grow Here Apparel from our art studios.

This includes apparel, Chapter Cards, vinyl stickers, collectibles, and other products available through the WGH store.

WGH may work with outside suppliers to source or produce products or materials, but customer orders are prepared, packaged, and shipped by We Grow Here Apparel.

WGH currently ships orders through USPS.

Shipping rates are calculated at checkout using applicable USPS rates based on factors including:

• Package weight
• Package size and dimensions
• Shipping destination
• Travel distance

Because shipping costs depend on the individual order and destination, shipping rates may vary between customers and orders.

Processing time is separate from carrier transit time.

WGH orders are normally prepared for shipment within approximately 1–2 business days, although processing may take longer during high-volume periods, launches, holidays, inventory counts, weather events, carrier interruptions, or other circumstances outside WGH’s reasonable control.

Delivery dates and transit times displayed by WGH, Shopify, or USPS are estimates unless the selected carrier service expressly provides a guaranteed delivery commitment.

WGH does not guarantee delivery by birthdays, holidays, travel dates, events, gift-giving dates, or other personal deadlines.

Although all products are fulfilled by WGH, products purchased in the same order may occasionally ship separately because of weight, package dimensions, inventory availability, packaging requirements, product protection, or USPS mailing requirements.

Customers are responsible for providing a complete and accurate shipping address.

WGH is not responsible for delivery issues resulting from incorrect or incomplete information provided by the customer.

Once a package has been carrier-confirmed as delivered to the address provided during checkout, the carrier delivery scan will be treated as evidence of delivery.

To the extent permitted by law, WGH is not responsible for theft, loss, misplacement, weather exposure, rain, snow, moisture, heat, sunlight, animals, or other damage occurring after confirmed delivery.

Additional shipping terms are governed by the WGH Shipping & Delivery Policy.

SECTION 6 — RETURNS, REFUNDS, REPLACEMENTS, AND FINAL SALE

All WGH products are final sale.

WGH does not accept standard returns or exchanges for correctly fulfilled products.

Eligible claims are limited to circumstances described in the WGH Refund, Replacement & Final Sale Policy, including situations where an item arrives:

• Materially damaged during shipping
• Materially defective
• Incorrect
• In the wrong size or color because of a WGH fulfillment error
• In the wrong quantity
• Missing from the package
• With a significant production or printing error
• Materially different from the confirmed order

Changes of mind, buyer’s remorse, ordering the wrong size or color, personal fit preferences, normal product variation, post-delivery damage, improper care, weather exposure after delivery, improper storage, improper application, normal wear, or misuse do not qualify for a standard return or refund.

When an eligible claim is approved, WGH determines the appropriate remedy.

Replacement is generally the preferred remedy when reasonably available.

A refund may be issued when WGH determines that replacement is unavailable or inappropriate, WGH expressly approves a refund, or applicable law requires one.

Customers must not mail products back to WGH without written return authorization.

Additional terms are governed by the WGH Refund, Replacement & Final Sale Policy.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and WGH creative materials are owned by or licensed to We Grow Here Apparel and are protected by applicable copyright, trademark, trade dress, and other intellectual property laws.

Protected materials may include:

• WGH logos
• Brand names
• Product artwork
• Illustrations
• Characters
• Apparel graphics
• Collectible artwork
• Product photography
• Videos
• Written stories
• Website copy
• Campaign materials
• Graphics
• Layouts
• Designs
• Slogans
• Creative concepts
• Earth School content
• Friendly Visitor content
• WGH Universe content
• Chapter artwork and stories

WGH brand identifiers and creative works may include, as applicable:

and other WGH names, designs, phrases, artwork, characters, or creative materials.

These Terms permit you to access the Services for personal, non-commercial use.

Unless WGH provides prior written permission, you may not:

• Reproduce WGH artwork
• Copy product graphics
• Create derivative designs
• Republish WGH stories
• Sell WGH content
• Copy WGH website content
• Use WGH branding commercially
• Manufacture products using WGH designs
• Use WGH photographs for unauthorized commercial purposes
• Distribute WGH creative works
• Represent WGH intellectual property as your own

Nothing in these Terms grants you ownership or a license to WGH intellectual property except the limited right to use the Services as expressly permitted.

All rights not expressly granted are reserved by We Grow Here Apparel.

SECTION 8 — OPTIONAL TOOLS

The Services may provide access to tools or functionality offered by third parties.

We do not necessarily monitor or control those third-party tools.

Third-party tools may be provided “as is” and “as available” and may be subject to separate terms, privacy practices, or conditions.

Your use of optional third-party tools is at your own discretion and risk.

You should review the applicable terms and policies of any third-party service before using it.

New tools, resources, or features added to the Services will also be subject to these Terms unless otherwise stated.

SECTION 9 — THIRD-PARTY LINKS

The Services may contain links, embedded features, materials, or services provided by third parties.

WGH is not responsible for independently operated third-party websites or services.

If you leave the WGH website to access a third-party website or service, you do so subject to that third party’s terms and policies.

WGH is not responsible for losses or damages arising solely from your use of third-party products, services, websites, or content except where applicable law provides otherwise.

Questions relating to third-party services should generally be directed to the applicable third party.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

We Grow Here Apparel is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and We Grow Here Apparel.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and We Grow Here Apparel, including injury, damage, or loss arising from products or services purchased from WGH.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising solely from purchases and transactions made directly with We Grow Here Apparel.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with the WGH Privacy Policy.

Because the Services are hosted by Shopify, Shopify may also collect and process information relating to your access to and use of the Services.

Information submitted through the Services may be transmitted to Shopify, payment providers, shipping providers, analytics providers, and other service providers where necessary to operate the store and fulfill orders.

Please review the WGH Privacy Policy and Shopify’s applicable privacy disclosures for additional information.

SECTION 12 — FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit reviews, ideas, suggestions, feedback, photographs, comments, proposals, or other content to WGH, you represent that you have the right to submit that content.

Unless prohibited by law or otherwise agreed in writing, you grant WGH a worldwide, non-exclusive, royalty-free license to use, reproduce, display, publish, adapt, and distribute submitted content for purposes related to operating, improving, and promoting WGH and the Services.

You may not submit content that:

• Violates another person’s intellectual property rights
• Violates privacy or publicity rights
• Is knowingly false or misleading
• Contains unlawful material
• Contains malware or harmful code
• Impersonates another person
• Misrepresents the origin of the submission

WGH may remove or decline to publish content that violates these Terms or applicable law.

You remain responsible for content you submit.

SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may occasionally contain errors, inaccuracies, or omissions involving:

• Product descriptions
• Product availability
• Pricing
• Promotions
• Shipping charges
• Shipping estimates
• Product images
• Inventory
• Website content
• Other store information

WGH reserves the right to correct errors, update information, modify affected orders, or cancel an order where reasonably necessary.

If WGH cancels an order after payment has been collected, the applicable amount will be refunded.

SECTION 14 — PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable law
• Commit or facilitate fraud
• Infringe WGH intellectual property
• Infringe the rights of another person
• Harass, threaten, abuse, defame, or harm another person
• Submit knowingly false or misleading information
• Distribute spam or unauthorized solicitations
• Impersonate another person or entity
• Upload malicious code
• Interfere with website security
• Bypass access restrictions
• Scrape or systematically copy WGH proprietary content without authorization
• Resell or commercially exploit the Services without permission
• Collect personal information about other users without authorization
• Attempt unauthorized access to WGH, Shopify, or related systems
• Use automated tools in violation of these Terms or applicable technical restrictions
• Engage in conduct that could damage WGH, Shopify, customers, or the Services

WGH may suspend, restrict, or terminate access when we reasonably believe these Terms have been violated.

SECTION 15 — AUTOMATED AGENTS

This section applies if you use software, artificial intelligence tools, bots, agents, or other automated or semi-automated systems to access or interact with the Services.

An automated agent may not conceal its automated nature or circumvent measures intended to control automated access.

WGH may limit, block, or restrict automated access to the Services.

Automated systems may not be used to:

• Circumvent security controls
• Bypass CAPTCHAs
• Scrape protected WGH intellectual property
• Perform fraudulent transactions
• Interfere with website operation
• Misrepresent automated activity as human activity where disclosure is required
• Circumvent technical restrictions on automated access

SECTION 16 — TERMINATION

WGH may suspend or terminate access to all or part of the Services when reasonably necessary, including for:

• Violation of these Terms
• Fraud
• Abuse
• Security risks
• Unauthorized use
• Payment disputes involving false information
• Intellectual property violations
• Conduct that threatens WGH, customers, or the Services

Termination does not eliminate payment obligations or other responsibilities arising before termination.

Sections relating to intellectual property, liability, indemnification, payment obligations, dispute records, privacy, and other provisions that logically survive termination will remain in effect.

SECTION 17 — DISCLAIMER OF WARRANTIES

The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

WGH does not guarantee that:

• The website will always be available
• The Services will be uninterrupted
• The Services will be error-free
• Every product will appear identical to digital photographs or screen displays
• Every third-party service will operate without interruption

Except where expressly stated by WGH or required by applicable law, WGH disclaims warranties to the fullest extent legally permitted, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to every customer.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, WGH and its owners, affiliates, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from:

• Use of the Services
• Inability to access the Services
• Third-party services
• Unauthorized use of customer accounts
• Misuse of WGH products
• Failure to follow product-care instructions
• Damage occurring after confirmed delivery
• Weather exposure after delivery
• Theft after confirmed delivery
• Circumstances outside WGH’s reasonable control

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

Where applicable law does not permit a complete limitation, WGH’s liability will be limited to the maximum extent permitted by law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless We Grow Here Apparel, Shopify, and their respective affiliates, employees, contractors, agents, licensors, and service providers from third-party claims, damages, liabilities, losses, or reasonable legal costs arising from:

• Your violation of these Terms
• Your violation of applicable law
• Your violation of another person’s rights
• Your unauthorized commercial use of WGH intellectual property
• Your misuse of the Services

WGH may control the defense of a covered claim where legally permitted.

You agree to reasonably cooperate in responding to such claims.

SECTION 20 — PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact info@wghapparel.com and allow WGH a reasonable opportunity to investigate an order issue before filing a chargeback or payment dispute.

A chargeback does not replace the claim requirements in the WGH Refund, Replacement & Final Sale Policy.

WGH may contest disputes that are:

• Fraudulent
• Duplicative
• Inconsistent with delivery records
• Inconsistent with customer communications
• Based on exclusions clearly stated in WGH policies
• Filed after a replacement, refund, or store credit has been accepted
• Based on inaccurate claims regarding authorization, delivery, damage, defects, or product description

WGH may provide relevant evidence to a payment processor, bank, or card issuer, including:

• Order records
• Payment records
• Checkout information
• Product descriptions
• Product photographs
• Size guides
• Shipping labels
• USPS tracking
• Fulfillment records
• Delivery scans
• Customer communications
• Claim documentation
• Refund or replacement records
• Store policies in effect when the order was placed

Nothing in this section prevents a customer from exercising rights that cannot legally be waived.

SECTION 21 — FRAUD AND POLICY ABUSE

To the extent permitted by law, WGH may decline claims, cancel unfulfilled orders, restrict purchases, request additional verification, or take other reasonable protective action when there is evidence of:

• Fraud
• False information
• Manipulated photographs
• Repeated unsupported claims
• Chargeback abuse
• Refund abuse
• Attempts to receive duplicate reimbursement
• Unauthorized commercial resale
• Intellectual property misuse
• Suspicious purchasing activity
• Other material abuse of WGH policies or Services

Decisions will be based on available records, the circumstances involved, and applicable law.

SECTION 22 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

SECTION 23 — WAIVER AND ENTIRE AGREEMENT

Failure by WGH to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with policies and rules incorporated by reference, constitute the agreement governing your use of the Services.

Applicable policies may include:

• Shipping & Delivery Policy
• Refund, Replacement & Final Sale Policy
• General Legal Notice
• Other checkout or promotional terms expressly incorporated into a transaction

SECTION 24 — ASSIGNMENT

You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written permission from WGH.

WGH may assign or transfer its rights and obligations as part of a business reorganization, sale, merger, transfer of assets, or other lawful business transaction.

SECTION 25 — GOVERNING LAW

These Terms and transactions with We Grow Here Apparel will be governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Where permitted by applicable law, disputes relating to these Terms or the Services will be subject to the jurisdiction of courts located in Denver, Colorado.

Nothing in this section limits rights or legal protections that cannot lawfully be waived.

Section headings are included for convenience and organization only.

They do not limit or otherwise affect the meaning of these Terms.

SECTION 27 — CHANGES TO THESE TERMS

You may review the current version of these Terms at any time through the WGH website.

WGH may update these Terms to reflect changes in:

• Business operations
• Fulfillment practices
• Product offerings
• Shopify functionality
• USPS or carrier procedures
• Payment processing
• Applicable laws
• WGH policies

Material changes will become effective when posted or on another date stated in the updated Terms, subject to applicable law.

The version of these Terms in effect when an order is placed will generally govern that transaction unless applicable law requires otherwise.
